Softspot Terms and Conditions

 

These are the general T&C’s of the business known as “SOFTSPOT” and the subsidiary business of “West Country Wedding DJ”, wholly owned by the sole trader Greg Fitzjohn.

 

These T&C’s may be overwritten by any specific agreement within your Booking Confirmation and any subsequent written or email agreements made prior to your event. Any such changes must be made in writing.

 

These T&C’s and the Booking Confirmation must be read as one.

 

Definitions.

 

We /Us/Our/Softspot

Refers to the owner and any employees of Softspot Disco or West Country Wedding DJ business and websites.

 

You / Hirer: the person who booked us as agreed in writing and who is legally responsible for booking the venue and the guests at your event.

Hirer must be at least 18 years of age.

 

Guests (paid/unpaid): Any individual(s) who attend your event whether by invitation, paid or unpaid, including the public. (It is your responsibility for refusing entry to anyone who is not invited)

 

Venue / managers. The owners or managers of the premises in which we are performing. (The Venue)

 

Booking Confirmation. The individual agreement in writing specifying the event details, venue, dates and times and any other specific requirements which form part of our Contract.

 

Bookings

 

All bookings made in writing, or electronically will be governed by the conditions herein.

 

Any agreements made by email, or in writing will become part of these T&C’s and may overwrite some of these general T&C’s

 

All bookings made by phone will be agreed in writing by email or paper, including event dates, venue, access and departure times, and playing times and payment terms. Bookings may be made be requested by phone, email or by our online booking forms and will be quoted for and confirmed by us by email. Further changes beyond this may be agreed in writing. Should you wish your event to go beyond the agreed official time we will agree with you an additional charge that must be paid at the start of the time of agreement during the event.

We generally require 1 hour to set up before your event and at least 1 hr after to clear (strike) our equipment, or as agreed in our Booking Confirmation. It is your responsible to ensure we have access during that time.

 

 Payment.

 

Payment must be made in advance by an agreed deposit or complete payment with at least cash at the start of the performance.

If you cancel within 2 months of your booking we will keep all money already paid to us.

 

The venue

You are responsible to ensure that:

The venue must:

  • Hold and comply with its various licences to perform:
  • Have a space for our presentation and playing area with a minimum space of 2 metres width and 2 metres minimum depth, or as otherwise agreed in your booking agreement
  • An adequate power supply (at least a standard 13A socket) should be within 5 metres unless agreed in advance. For larger set-ups or outside space additional power supply may need to be agreed
  • The use of additional effects such as smoke machines, pyrotechnics, sound volume, and lasers (which should be checked by hirers) will be limited by local room restrictions, and local authority restrictions, and will not attract any discount or refund

 

Cancellation

 

By You: If you cancel within 2 months of your booking we will keep any money you have already paid to Us

 

By Us: If we cancel due to any reason not covered by Force majeure we will repay any monies paid to us and this will be the maximum limit of our compensation to you.

 

 

Events beyond our control (force majeure). We (SOFTSPOT) will not be legally responsible for any compensation if we are prevented from carrying out our performance under this contract as a result of events beyond our control. 

This includes but is not limited to COVID-19 regulations or requirements.

 

Conduct of Guests

 

You are responsible for the orderly and lawful behaviour of your guests and we reserve the right to suspend or finish our performance early where we reasonably believe there is a danger to us, our equipment, and members of the public or yourself. In such event we will not give any refund, and will demand any full payment. YOU will be responsible for any damage to our equipment caused by disorderly behaviour of your guests.

 

Promotions and advertising.

You will allow us to promote ourselves by way of announcements or tabletop leaflets / request forms during the event. You will allow us to use any images / videos on our website, or in a Blog (without giving personal details) and will remove or obscure any part of personally identifiable images at your request.

 

These Terms and Conditions will be governed by the laws of England.
